1. About These Terms

These Terms of Use ("Terms") govern your use of the PROMARE Boat Charter website at promare.hr and the booking of any tours, private charters, or transfer services provided by PROMARE ("Services").

By browsing our website or submitting an inquiry or booking, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our website or Services.

PROMARE Boat Charter is registered in Croatia and operates from Makarska Harbour, 21300 Makarska, Croatia. Contact: info@promare.hr.

2. Bookings and Confirmation

A booking is accepted and confirmed only upon receipt of a written confirmation from PROMARE (by email). Submitting an inquiry does not constitute a confirmed reservation.

  • Bookings may be made by email or through our website contact/inquiry form.
  • A booking is binding once PROMARE sends a written confirmation and, where applicable, a deposit has been received.
  • The lead passenger (the person making the booking) must be at least 18 years old and accepts these Terms on behalf of all members of the group.
  • Please ensure that all information provided at the time of booking (dates, guest count, special requests) is accurate. PROMARE is not liable for issues arising from incorrect information provided by the guest.

3. Pricing and Payment

All prices are quoted in Euros (EUR) and are inclusive of Croatian VAT where applicable. Prices are subject to change without notice until a booking is confirmed in writing.

  • Group tours: Payment is typically made in full at the point of boarding or as agreed in the booking confirmation.
  • Private charters and special events: A deposit may be required to secure the booking. The remaining balance is due on the day of the tour or as specified in the confirmation.
  • We accept payment by bank transfer or cash. Specific payment methods will be confirmed at the time of booking.

4. Cancellation and Refunds

Cancellation by the guest

  • More than 7 days before departure: Full refund of any deposit paid.
  • 3–7 days before departure: 50% of the total booking value is retained.
  • Less than 48 hours before departure: No refund. The full booking value is charged.
  • All cancellations must be made in writing to info@promare.hr. Cancellation takes effect on the date the written notice is received by PROMARE.

Cancellation by PROMARE

PROMARE reserves the right to cancel or modify any tour due to adverse weather conditions, sea state, mechanical issues, or force majeure events that make it unsafe or impractical to operate. In such cases:

  • You will be offered a full rescheduling to an alternative date, or
  • A full refund of any amounts paid.

PROMARE shall not be liable for any additional costs you incur (such as travel, accommodation, or other expenses) in the event of a cancellation beyond our control.

5. Safety and Conduct

The safety of our guests and crew is our absolute priority. By booking with PROMARE, you agree to:

  • Follow all instructions given by the skipper and crew at all times. The skipper has final authority over all decisions related to navigation and safety.
  • Wear a life jacket when instructed to do so by the crew. Life jackets are provided in all sizes, including for children.
  • Refrain from boarding if you are under the influence of alcohol or drugs to a degree that may impair your safety or the safety of others. PROMARE reserves the right to refuse boarding in such cases without refund.
  • Not stand or move on the vessel in a manner that is dangerous, as determined by the skipper.
  • Treat the vessel, equipment, and fellow passengers with respect. Any damage caused intentionally or through negligence may be charged to the responsible party.

Children under the age of 14 must be accompanied and supervised by a responsible adult at all times.

6. Health and Physical Fitness

Boat tours involve exposure to sun, sea spray, waves, and vessel motion. Guests are responsible for assessing their own suitability to participate. We strongly recommend:

  • Consulting your doctor before booking if you have a heart condition, severe motion sickness, pregnancy, or any other condition that may be affected by sea travel.
  • Informing PROMARE at the time of booking of any medical conditions or mobility requirements so that we can advise appropriately.

PROMARE does not carry medical personnel on board. A basic first aid kit is available on all vessels. In the event of a medical emergency at sea, the nearest coastguard or emergency services will be contacted immediately.

7. What Is Included

Unless stated otherwise in the specific tour description on our website or booking confirmation, the following are included in the tour price:

  • Experienced, licensed skipper and crew
  • Life jackets for all guests
  • Snorkelling equipment (on applicable tours)
  • Fuel and port fees
  • Complimentary refreshments as stated in the tour description

The following are typically not included unless explicitly stated: travel to/from the departure point, food and beverages beyond what is described, island entrance fees, gratuities, and personal travel insurance.

8. Limitation of Liability

PROMARE's liability to guests is limited to the amount paid for the specific tour or service in question. We are not liable for:

  • Indirect, consequential, or incidental losses, including loss of enjoyment.
  • Losses caused by circumstances beyond our reasonable control, including severe weather, acts of God, government restrictions, or maritime authority directives.
  • Personal injury or death caused by a guest's failure to follow safety instructions given by the skipper or crew.
  • Loss, theft, or damage to personal belongings brought on board. Guests are responsible for securing their own valuables.

Nothing in these Terms limits our liability for death or personal injury caused by our proven gross negligence or intentional misconduct.

9. Travel Insurance

We strongly recommend that all guests obtain appropriate travel insurance prior to their tour, covering cancellation, medical expenses, personal accidents, and loss of personal property. PROMARE does not provide travel insurance and is not responsible for any costs that would otherwise be covered by travel insurance.

10. Photography and Media

PROMARE crew may take photographs or video footage during tours for use in our marketing materials and social media. By joining a tour, you consent to being featured in such media. If you do not wish to be photographed, please inform the crew at the start of the tour and we will respect your preference.

Guests may photograph and film freely for personal, non-commercial use during tours.

11. Website Use

The content on promare.hr — including text, images, logos, and tour descriptions — is the property of PROMARE Boat Charter and is protected by copyright. You may not reproduce, distribute, or commercially exploit any content without our prior written consent.

We make reasonable efforts to ensure information on our website is accurate and up to date, but we do not guarantee that it is free from errors or omissions. Tour availability, pricing, and itineraries are subject to change.

12. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Croatia. Any dispute arising from or relating to these Terms or our Services that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the competent courts in Split, Croatia.

For EU consumers, these Terms do not affect any mandatory statutory rights you have under the laws of your country of residence.

13. Changes to These Terms

PROMARE reserves the right to update these Terms at any time. The version in effect at the time of your booking confirmation will apply to that booking. Continued use of our website after changes are posted constitutes acceptance of the updated Terms.
