We are committed to protecting your personal data and complying with the EU General Data Protection Regulation (GDPR) and the Croatian Personal Data Protection Act.

2. What Data We Collect

We collect personal data only when you provide it to us voluntarily or when it is generated as a result of your use of our website. The categories of data we may collect include:

  • Contact and booking data: First name, last name, email address, phone number, preferred tour date, number of guests, and any messages you send us via the inquiry or contact form.
  • Communication data: Records of correspondence between you and PROMARE, including emails and WhatsApp messages.
  • Technical data: IP address, browser type and version, time zone, pages visited, and other diagnostic data collected automatically when you access our website. This data is collected in aggregate and is not linked to your identity.

We do not collect any special categories of sensitive personal data (such as health information, race, or religion) and we do not collect payment card information directly — any payments are processed through secure third-party providers.

3. How We Use Your Data

We use your personal data for the following purposes:

  • To respond to your inquiry and provide you with information about our tours and services (legal basis: legitimate interest / pre-contractual steps).
  • To confirm and manage your booking, including sending booking confirmations and pre-departure information (legal basis: performance of a contract).
  • To send you safety or operational updates relevant to your booking, such as weather-related changes (legal basis: legitimate interest).
  • To improve our website and services using aggregated, anonymised analytics data (legal basis: legitimate interest).
  • To comply with our legal obligations, such as accounting and tax records (legal basis: legal obligation).

We will only send you marketing emails if you have explicitly consented, and you can withdraw that consent at any time.

4. How Long We Keep Your Data

We retain personal data only for as long as necessary for the purposes stated above:

  • Inquiry data that does not result in a booking is deleted within 12 months.
  • Booking records (name, contact, dates, guest count) are kept for 7 years to comply with Croatian accounting and tax law.
  • Marketing consent records are kept until you withdraw consent.
  • Technical/analytics data is retained in anonymised, aggregated form indefinitely.

5. Sharing Your Data

We do not sell or rent your personal data to any third party. We may share your data with trusted service providers who assist us in operating our business, strictly under data processing agreements:

  • Email and communication tools (e.g. Google Workspace) for managing correspondence.
  • Website hosting — our website is hosted on servers within the European Economic Area (EEA).
  • Analytics providers — we may use privacy-friendly analytics tools. Where third-party analytics are used, data is anonymised or processed under a data processing agreement.

We may also disclose your data if required by law, a court order, or a legitimate request from a Croatian public authority.

  • Right to rectification: Ask us to correct inaccurate or incomplete data.
  • Right to erasure ("right to be forgotten"): Request deletion of your data, subject to our legal retention obligations.
  • Right to restrict processing: Ask us to limit how we use your data in certain circumstances.
  • Right to data portability: Receive your data in a structured, machine-readable format.
  • Right to object: Object to processing based on legitimate interest, including direct marketing.
  • Right to withdraw consent: Where processing is based on consent, withdraw it at any time without affecting the lawfulness of prior processing.

We take reasonable technical and organisational measures to protect your personal data against unauthorised access, loss, or disclosure. Our website uses HTTPS encryption. Access to personal data within our organisation is limited to those who need it to carry out their work.

No method of transmission over the internet is 100% secure. If you have reason to believe that your interaction with us is no longer secure, please contact us immediately.

Our website may contain links to third-party websites (for example, Google Maps, TripAdvisor, or social media platforms). This Privacy Policy applies only to our website.
